These Terms of Use ("Terms") govern your access to and use of BioNurture’s website, online forms, scheduling links, and any non-clinical digital features (collectively, the "Platform"). By accessing or using the Platform, you agree to these Terms.

1. Medical Emergency Warning

The Platform is not for emergency or urgent care. If you believe you have a medical emergency, call 911 immediately or go to the nearest emergency department.

2. Platform Content Is Not Medical Advice

Content on the Platform is provided for general informational purposes only and does not constitute medical advice. Clinical services are provided only through a formal clinician-patient relationship established after intake review, acceptance, required consents, and an initial clinical encounter when applicable.

3. Eligibility

You must be at least eighteen (18) years old to use the Platform for yourself. If you are using the Platform on behalf of another person, you represent that you have legal authority to do so.

4. Telemedicine Availability and Location

BioNurture provides telemedicine services only where permitted by law and only when the treating clinician is licensed and authorized to provide care to you in the state where you are physically located at the time of the clinical encounter. Accessing the Platform does not guarantee that clinical services are available in your location.

If you create an account or portal login, you are responsible for maintaining the confidentiality of your credentials and for all activity conducted under your account.

The Platform and its content (including text, graphics, logos, and design elements) are owned by BioNurture or its licensors and are protected by intellectual property laws. You may not use BioNurture trademarks or content except as expressly permitted in writing.

8. Third-Party Services

The Platform may integrate or link to third-party services (e.g., scheduling, video, payment processors). BioNurture is not responsible for third-party services, content, or privacy practices, and your use of third-party services may be governed by their own terms.

Your use of the Platform is governed by the BioNurture Privacy Policy. If you become a BioNurture patient, your Protected Health Information is governed by the BioNurture Notice of Privacy Practices.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

To the maximum extent permitted by law, BioNurture will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the Platform.

12. Dispute Resolution; Arbitration; Class Action Waiver

To the maximum extent permitted by applicable law, disputes arising out of or relating to the Platform or these Terms will be resolved by binding arbitration on an individual basis and not as a class, collective, or representative action. Either party may bring an eligible claim in small claims court. If a state law requires specific arbitration disclosures or prohibits arbitration for certain claims, those rules control and this provision will be enforced only to the extent permitted.

13. Changes to Terms

BioNurture may update these Terms by posting a revised version and updating the "Last Updated" date. Your continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.
